How California Overtime Law Works (Labor Code § 510)
California has some of the strongest overtime protections in the United States, mandating both daily and weekly overtime thresholds:
1. Time and a Half (1.5×)
- All hours worked exceeding 8 hours up to 12 hours in a workday.
- All hours worked exceeding 40 straight hours in a workweek.
- The first 8 hours worked on the 7th consecutive workday.
2. Double Time (2.0×)
- All hours worked exceeding 12 hours in any single workday.
- All hours worked exceeding 8 hours on the 7th consecutive workday.
3. No Pyramiding Rule
Under California law, hours already compensated at daily overtime or double-time rates are excluded from the 40-hour weekly calculation to prevent double-counting.
